TRANSITIONAL LANGUAGE ARRANGEMENTS (max. 12 years) Request for Unitary Effect to be filed together with a full English translation if the European patent is granted in French or German a full translation into any language of the participating EU member states (except Spanish and Italian) if the European patent is granted in English (for information only, no legal effect) The obligation to file translation is temporary (max. 12 years) and will end when high quality machine translations become available. ANNUITY FEE PAYMENTS FOR THE UNITARY PATENT Unitary Patent annuity fees paid to the EPO no final decision on the amount of the unitary annuity fee some consideration for setting the fee as the aggregate of the national annuity fees of the 5 most expensive participating EU member states the European patent with Unitary Effect must be maintained or abandoned only as a whole, no partial lapse for individual countries (all eggs in one basket) NO DOUBLE PROTECTION by requesting Unitary Effect, the European patent is deemed not to have taken effect as a national patent in the (25) participating EU member states Hence, no double protection by a unitary patent and a traditional European patent taking effect on the territories of the EU member states TAKES EFFECT - BEGINNING After 13 participating member states have ratified the Agreement (which must include France, Germany and the UK) the Agreement takes effect. Thereafter, any European patent can benefit from the Unitary Effect in all participating member states that have ratified the Agreement. Example: The 13th participating member state ratifies the Agreement. A European patent has granted and is still within the 1 month time limit for requesting Unitary Effect. The patent proprietor can request Unitary Effect for these 13 states. Protection for remaining EU member states which have not yet ratified the Agreement, must be pursued by traditional national validation of the European patent. As additional countries enter the Agreement, requests for Unitary Effect also will apply to the additional countries (but not retroactively). Actions for declaration of non-infringement. Appeals against Decisions of the EPO concerning the additional tasks related to the unitary patent (only central division) Any action which would have been brought to a Local/Regional Division in a Contracting State that neither hosts a Local Division nor participates in a Regional Division. Actual infringement of threatened infringement actions Local/Regional Division of the Contracting State where the infringement occurred or may occur OR Local/Regional Division of the Contracting State where one of the defendants has his residence, principal place of business or place of business (but only in the absence of residence or principle place of business)
